Once you have found the property you wish to buy, you need to place a reservation to ensure that it is taken off the market. This is done by paying a reservation deposit, typically between €3,000 and €6,000, depending on the value of the property. The reservation agreement will contain the terms of the purchase and a deadline for completing the sale.
All foreign buyers need a NIE number (Número de Identificación de Extranjero) to purchase property in Spain. This is a Spanish tax identification number that is required for many formal transactions. Our collaborating law firm will help you apply for the NIE number quickly and easily, so you don't have to do it yourself.
It is important to engage an independent, local lawyer who will perform due diligence on the property and ensure that everything is legally in order. Our collaborating law firm will check the property register, confirm ownership, investigate any debts or charges on the property, and ensure that all necessary licenses and permits are in place.
Once due diligence is completed and everything is in order, your lawyer will prepare a purchase contract (Contrato de Compraventa) that outlines the terms of the purchase, the property's price, and the payment schedule. Both parties will sign the contract, and the buyer will typically pay a deposit of 10% of the purchase price (minus the reservation deposit). Then, you and the seller must meet with a notary public, who will review the purchase contract to ensure all parties understand the terms and that the contract complies with Spanish law
Once all necessary documents are signed and the notary public has authenticated the contract, the completion of the purchase will take place. At this point, you will pay the remainder of the purchase price to the seller, and the property will be formally transferred to you. Your lawyer will ensure that the property is registered in your name in the Spanish property register and that all necessary taxes and fees are paid.
